1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the website fingerlakesmartialartscenter.com (the "Site"), our contact and trial-request forms, our booking calendars, our web chat widget, and our email and SMS text messaging programs, all operated by Finger Lakes Martial Arts Center ("the academy," "we," "us," or "our").

By using the Site, submitting a form, using the web chat widget, or opting in to receive messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or send us information.

2. About Us

Finger Lakes Martial Arts Center has provided martial arts instruction to students of all ages and ability levels in Geneva, New York since 2003. We teach Brazilian Jiu Jitsu and traditional Yee's Hung Ga Kung Fu, and we are Haven Jiu Jitsu's Geneva, New York affiliate.

3. Eligibility and Use of the Site

You must be at least 18 years old to submit a form, use the web chat widget, or opt in to messaging. If you are enrolling a student under 18, you confirm that you are that student's parent or legal guardian and have authority to give the information and consents requested.

You agree not to:

- Use the Site for any unlawful purpose or in violation of these Terms

- Submit false, misleading, or another person's information

- Submit a phone number you are not authorized to give consent for

- Attempt to gain unauthorized access to the Site, its servers, or connected systems

- Use automated means to scrape, harvest, or interfere with the Site

- Send malicious code, spam, or harassing content through our forms or chat widget

We may suspend or end access to the Site or our messaging programs at any time for violation of these Terms.

4. Forms, Booking Calendars, and the Free Trial Offer

4.1 Submitting a form

The Site includes forms that let you request information and claim a free trial class. Submitting a form is a request — it does not create an enrollment agreement, reserve a place in any class, or obligate either party until we confirm your booking.

By submitting a form you confirm the information is accurate and that you own, or are an authorized user of, the phone number and email address you provide.

4.2 Booking calendars

Some pages include a scheduling calendar for reserving a class directly. You select a program, date, and time and provide your name, email address, and mobile number.

A notice displayed with the phone field explains that we will text you about that booking. Numbers given through a booking calendar receive booking-related messages only — confirmations, reminders, and notice of schedule changes or cancellations. Booking a class does not enroll you in marketing messages, which require the separate express consent described in Section 6.

A calendar booking reserves a place subject to availability and our confirmation, and does not create an enrollment agreement. All participants must complete a waiver before attending, as described in Section 8.

4.3 Free trial offer

The free trial class is subject to the following:

- Available to new students only, one per student, and generally one per household.

- Subject to class availability, age-appropriate program placement, and instructor approval.

- Must be scheduled in advance and used within 30 days of your inquiry unless we agree otherwise in writing.

- No cash value, non-transferable, and not combinable with other offers unless we say so.

- All participants must complete a waiver, and for minors a parent or legal guardian must complete and sign it, before taking part.

- We may modify or discontinue the offer at any time. Offers already claimed will be honored.

- Claiming the offer does not require you to consent to marketing text messages or emails. Consent boxes on our forms are optional and are never a condition of receiving the free trial.

4.4 Morning classes and RSVP

Morning classes run on an RSVP basis and are scheduled around how many students can attend on a given day. Reserving a morning session is a request, not a guarantee that the session will run. We will notify you if a session is cancelled or rescheduled. RSVP reminders and cancellation notices are non-marketing messages under Section 6.

5. Web Chat Widget

The Site provides a web chat widget for visitors with questions. By using it:

- You agree your messages may be stored, reviewed by staff, and used to answer your question and improve service.

- You agree not to send sensitive personal information, payment card numbers, or detailed medical records through the chat.

- If you give your mobile number in chat, you agree we may reply by text. Giving a number in chat does not enroll you in marketing messages; those require the separate express consent in Section 6.

- Chat responses may be delayed and are not monitored 24 hours a day. Do not use the chat widget for emergencies. In an emergency, call 911.

- Information given through chat is general and is not a binding offer, enrollment, or guarantee of pricing or availability.

6. SMS / Text Messaging Program Terms

These messaging terms form part of these Terms of Service.

6.1 Program description

Finger Lakes Martial Arts Center operates two text messaging programs for people who have expressly opted in:

- Non-marketing messages — replies to your inquiry, class information, scheduling and appointment confirmations and reminders, RSVP confirmations for morning classes, enrollment instructions, schedule changes, and closure or cancellation notices.

- Marketing and promotional messages — special offers, discounts, promotions, seminars, events, and program announcements, limited to programs you indicated an interest in.

6.2 Consent and opt-in

You may opt in by checking the applicable unchecked consent box on a form on fingerlakesmartialartscenter.com or on a paper form at the academy, or by texting us to request messages. Each program has its own separate consent box; you may consent to one, both, or neither.

You may also receive booking-related texts by giving your mobile number when reserving through a booking calendar, as described in Section 4.2. Numbers given that way receive non-marketing booking messages only.

Consent to receive marketing or non-marketing text messages is not a condition of purchasing any goods or services, claiming the free trial, or enrolling in any program. Consent boxes are never pre-checked, and our forms can be submitted without checking them.

You confirm that you are the subscriber or customary user of the mobile number you give, that you are at least 18, and that you will tell us if you stop using that number.

6.3 Message frequency

Message frequency varies based on your interaction with us and on current promotions.

6.4 Cost

Message and data rates may apply. We send messages at no charge, but your mobile carrier's standard messaging and data rates apply according to your plan. Contact your carrier for details.

6.5 Opting out — STOP

You can cancel the SMS service at any time. Simply text "STOP" to the number from which you received the message. After you send "STOP," we will send an SMS confirming you have been unsubscribed, after which you will no longer receive SMS messages from us. To join again, sign up as you did the first time and we will resume sending messages.

6.6 Getting help — HELP

If at any time you forget what keywords are supported, or need assistance, text "HELP" to the number from which you received the message. After you send "HELP" we will reply with instructions on how to use the service and how to unsubscribe. You may also contact us at (315) 436-5425 or [email protected].

6.7 Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery depends on transmission by your mobile carrier and is outside our control. We are not liable for delays, failures, or errors in delivery.

Supported carriers may change without notice. Messages may not be deliverable to all devices or all areas.

6.8 Privacy of mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See Sections 4 and 7 of our Privacy Policy for full details.

7. Email Communications

If you give us your email address, you agree we may email you in reply to your inquiry and about class information, scheduling, and enrollment. Marketing emails are sent only where permitted, and each includes an unsubscribe link. Unsubscribing from marketing emails does not stop transactional emails about an active enrollment or a scheduled class.

8. Classes, Enrollment, and Assumption of Risk

- Information on the Site about schedules, pricing, and program availability may change without notice and is not a binding offer. Class times, including morning RSVP sessions, are subject to change.

- Martial arts training involves physical activity and carries an inherent risk of injury. Brazilian Jiu Jitsu in particular involves close physical contact, grappling, and controlled live training with partners. All participants — or the parent or legal guardian of a participant under 18 — must read and sign our waiver and release of liability before taking part in any class, including free trial classes.

- Participants are responsible for disclosing any medical condition, injury, or physical limitation affecting safe participation, and for consulting a physician before beginning training.

- Students are expected to train with control and to treat training partners with respect. We may refuse, suspend, or end participation of any student whose conduct is unsafe, disruptive, or inconsistent with the standards of the academy.

- Competition is optional. Students who choose to compete do so voluntarily and are responsible for the rules, entry fees, and requirements of the organizing body.

- Rank and belt promotion are awarded at the discretion of the head instructor based on skill, understanding, attendance, and conduct. Enrollment, payment, or time spent training does not entitle a student to promotion.

- Any discounts we offer — including for law enforcement officers, correction officers, military personnel, first responders, and college students — are subject to eligibility verification, current availability, and change without notice.

9. Intellectual Property

All content on the Site — text, graphics, logos, photographs, video, curriculum descriptions, and the Finger Lakes Martial Arts Center name and marks — belongs to the academy or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission.

The Haven Jiu Jitsu name and marks belong to their owner and are used under our affiliation with them.

Photographs and video taken at the academy remain our property. We use images of minor students in promotional material only where a parent or legal guardian has given separate written media-release permission.

10. Third-Party Links and Services

The Site may link to third-party websites and services, including social media platforms. We do not control and are not responsible for their content, terms, or privacy practices. Links do not imply endorsement.

11. Disclaimer of Warranties

THE SITE, THE WEB CHAT WIDGET, THE BOOKING CALENDARS, AND OUR MESSAGING PROGRAMS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MESSAGES WILL BE DELIVERED.

Nothing on the Site is medical advice. Consult a qualified healthcare professional before beginning any physical training program.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINGER LAKES MARTIAL ARTS CENTER AND ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, THE CHAT WIDGET, THE BOOKING CALENDARS, OR OUR MESSAGING PROGRAMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits liability that cannot be limited under applicable law. This Section 12 does not apply to claims arising from in-person participation in classes, which are governed by the separate waiver and release you sign.

13. Indemnification

You agree to indemnify and hold harmless Finger Lakes Martial Arts Center and its owners, instructors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, your submission of a phone number or email address you were not authorized to provide, or your violation of any law or third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Ontario County, New York, and you consent to the jurisdiction of those courts.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest will remain in full force. These Terms, together with our Privacy Policy and any waiver or enrollment agreement you sign, are the entire agreement between you and Finger Lakes Martial Arts Center regarding the Site and our messaging programs.

Our failure to enforce any provision is not a waiver of it.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and changing the "Last Updated" date. Material changes will be given more prominent notice. Continuing to use the Site after changes take effect means you accept the revised Terms.
