1. Introduction
Finger Lakes Martial Arts Center ("Finger Lakes Martial Arts Center," "the academy," "we," "us," or "our") operates the website fingerlakesmartialartscenter.com (the "Site") and provides Brazilian Jiu Jitsu and traditional Kung Fu instruction at our academy located at 122 N Genesee St, Suite A303, Geneva, NY 14456.
This Privacy Policy explains what information we collect, how we use it, who we share it with, and what choices you have. It covers the Site, our contact and trial-request forms, our booking calendars, our web chat widget, and our email and SMS text messaging programs.
By using the Site or submitting information to us, you agree to the practices described here. If you do not agree, please do not use the Site or send us information.
2. Information We Collect
2.1 Information you give us directly
- Contact details — your first and last name, phone number (including mobile number), and email address.
- Prospective student information — the program you are interested in (Kids Brazilian Jiu Jitsu, Adult Brazilian Jiu Jitsu, Kung Fu, or Fundamentals), the age of the prospective student, and preferred class times.
- Parent or guardian information — where the prospective student is under 18, the name and contact details of the enrolling parent or legal guardian.
- Messaging consent records — whether you checked the box consenting to non-marketing text messages, whether you checked the box consenting to marketing and promotional text messages, and the date, time, and page on which you gave that consent.
- Class booking information — when you reserve a class through a scheduling calendar on the Site, the program, date, and time you select, along with your name, email address, and mobile number.
- RSVP information — our morning classes run on an RSVP basis. If you reserve a morning session, we record which session you requested so we know whether we have the numbers to run it.
- Web chat messages — the content of anything you send through the chat widget, along with any name, email address, or phone number you provide inside that chat.
- Enrollment and membership information — if you enroll, we collect what we need to run a membership safely: emergency contact details, any medical condition or physical limitation you disclose for safety purposes, belt rank and attendance records, and billing information.
- Competition information — if you choose to compete, we may process registration details on your behalf for tournament organizers such as the IBJJF.
- Correspondence — the content of emails, text messages, voicemails, and other communications you send us.
2.2 Information collected automatically
When you visit the Site, we and our service providers may automatically collect:
- IP address and the approximate general location derived from it
- Browser type and version, operating system, and device type
- Pages viewed, links clicked, referring URL, and time spent on pages
- Date and time of your visit
- Cookie identifiers and similar tracking technologies
2.3 What we do not collect
We do not knowingly collect Social Security numbers, government identification numbers, precise geolocation data, or biometric information through the Site.
3. How We Use Your Information
We use the information we collect to:
- Respond to inquiries you submit through our forms or the web chat widget
- Schedule and confirm free trial classes, RSVP morning sessions, and appointments
- Send class information, schedule changes, closures, cancellations, and enrollment instructions
- Administer membership, belt promotion, testing, and attendance
- Support students who choose to compete, including tournament registration
- Send marketing and promotional messages about offers, discounts, seminars, events, and program announcements — only where you have separately consented, and only about programs you indicated interest in
- Process payments and maintain billing records
- Maintain emergency contact and safety records for enrolled students
- Improve the Site, understand how visitors use it, and diagnose technical problems
- Comply with legal obligations and enforce our Terms of Service
4. SMS and Text Messaging Program
This section explains how we handle mobile numbers and messaging consent. Please read it carefully.
4.1 How you opt in
We text only people who have given us express written consent. You may opt in by:
- Checking the applicable unchecked consent box on a form on fingerlakesmartialartscenter.com and submitting the form
- Providing your mobile number when you reserve a class through a booking calendar on the Site, where a notice displayed with the phone field explains that we will text you about that booking
- Providing your mobile number and checking the applicable consent box on a paper form completed in person at the academy
- Texting a keyword to us, or replying to a message from our number, to affirmatively request messages
- Consent boxes on our forms are never pre-checked, and consenting to text messages is never a condition of submitting a form, claiming a free trial class, buying anything, or enrolling in any program.
4.2 Two separate consents
We keep two distinct consents. You may give one, both, or neither:
- Non-marketing (conversational and transactional) messages — replies to your inquiry, class information, scheduling, appointment and RSVP reminders, enrollment instructions, closures, and account matters.
- Marketing and promotional messages — special offers, discounts, promotions, seminars, events, and program announcements, limited to programs you indicated an interest in.
4.3 Message frequency and cost
Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
4.4 How to opt out
You may cancel text messages at any time by replying STOP to any message from us. We will send one final message confirming you have been unsubscribed, after which you will receive no further texts unless you opt in again. For help, reply HELP or contact us at (315) 436-5425 or [email protected].
Opting out of marketing messages does not remove you from non-marketing messages you separately consented to, and the reverse is also true. To stop all messages, reply STOP or contact us directly.
4.5 No sharing of mobile information — carrier-required disclosure
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We do not sell, rent, lease, trade, or otherwise share or provide your mobile phone number or your SMS messaging consent data to any third party or affiliate for their own marketing or promotional purposes, under any circumstances.
5. Web Chat Widget
The Site offers a web chat widget so visitors can ask questions and get answers. When you use it:
- We collect the messages you send, along with any name, email address, or phone number you choose to provide.
- Chat transcripts are stored in our customer relationship management system and may be reviewed by staff to answer your question and improve service.
- If you give a mobile number in chat, we may continue the conversation by text so we can answer you. We will not add you to marketing or promotional texting from a chat conversation unless you separately and expressly consent to marketing messages.
- Please do not send sensitive personal information, payment card numbers, or detailed medical information through the chat widget.
6. Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Site, remember preferences, and understand usage. These may include:
- Strictly necessary cookies required for the Site and forms to work
- Analytics cookies that show us which pages visitors view
- Advertising and conversion cookies that measure how our advertising performs
You can control cookies through your browser settings; disabling them may break parts of the Site. Cookie and advertising identifiers are separate from, and never include, your mobile number or text messaging consent data.
7. How We Share Information
We share personal information only in the limited circumstances below.
7.1 Service providers and subcontractors
We use vendors to run the business — website hosting, customer relationship management and messaging platforms, email delivery, payment processing, scheduling software, and analytics. These vendors process information only on our instructions and only to provide services to us, and are contractually barred from using it for their own purposes.
As stated in Section 4.5, mobile information and SMS consent data are never shared with third parties or affiliates for marketing or promotional purposes. Sharing with subcontractors that provide support services on our behalf, such as our messaging platform and customer service tools, is limited strictly to delivering the messages you asked to receive.
7.2 Affiliation and competition
Finger Lakes Martial Arts Center is an affiliate of Haven Jiu Jitsu. Affiliation covers curriculum, instruction, and rank recognition. It does not involve sharing your contact details or mobile number for marketing purposes. Where you choose to compete, we may share the registration details a tournament organizer requires, with your knowledge, for that specific event.
7.3 Legal and safety
We may disclose information where required by law, subpoena, court order, or other legal process, or where we believe in good faith that disclosure is necessary to protect the rights, safety, or property of the academy, our students, or the public — including in a medical emergency involving a student.
7.4 Business transfer
If the academy is involved in a merger, acquisition, reorganization, or sale of assets, personal information may transfer as part of that transaction. Any successor remains bound by this Policy, including the mobile information restrictions in Section 4.5.
7.5 With your direction
We share information when you ask us to.
7.6 What we never do
We do not sell your personal information. We do not rent or trade mailing lists. We do not share your mobile phone number or messaging consent with third parties or affiliates for marketing or promotional purposes.
8. Children's Privacy
Our programs include instruction for minors, and protecting their information is a serious responsibility.
- The Site, our forms, and our web chat widget are intended for adults age 18 and over. We do not knowingly allow children under 13 to submit personal information through the Site.
- Where a prospective or enrolled student is under 18, forms must be completed by that student's parent or legal guardian, using the parent or guardian's own contact details.
- All SMS and email consent for a minor student must be given by the parent or legal guardian using the parent or guardian's own mobile number and email address. We do not send marketing text messages to minors.
- We collect only what is necessary to teach a minor safely — name, age, physical limitations disclosed by the parent, attendance, and rank.
- If you believe a child under 13 has given us personal information directly, contact us at [email protected] and we will delete it promptly.
Photographs and video of minor students appear in promotional material only where a parent or legal guardian has given separate written media-release permission, which may be withdrawn at any time.
9. Data Retention
We keep personal information only as long as needed for the purposes described here:
- Inquiry and lead information — up to 24 months from your last interaction, unless you ask us to delete it sooner.
- SMS and email consent records — at least 4 years after consent is given or withdrawn, because messaging regulations require us to be able to prove consent existed.
- Opt-out records — indefinitely, so we can honor your STOP request and avoid contacting you again.
- Student and membership records — for the length of enrollment and up to 7 years afterward, for accounting, tax, insurance, and rank-verification purposes.
- Web chat transcripts — up to 24 months.
10. Security
We use reasonable administrative, technical, and physical safeguards, including encrypted transmission over HTTPS, access controls limiting staff access to what each person needs, and reputable vendors that maintain their own security programs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Your Rights and Choices
At any time you may:
- Stop text messages — reply STOP to any message from us.
- Stop marketing emails — click the unsubscribe link in any marketing email, or contact us.
- Access or correct your information — request a copy of what we hold about you, or ask us to fix it.
- Delete your information — ask us to delete your personal information, subject to records we must legally retain (consent and opt-out records, financial records).
- Withdraw consent — withdraw any consent you gave previously, without affecting the lawfulness of processing before withdrawal.

Depending on where you live, you may have additional rights under state privacy laws, including the right to appeal a denied request. To appeal, reply to our response or contact us at the address above.
12. Third-Party Links
The Site may link to third-party websites and social media pages, including Facebook and Instagram. We are not responsible for their privacy practices or content. Please read the privacy policy of any site you visit.
13. Do Not Track
Some browsers offer a "Do Not Track" signal. There is currently no industry-standard response to these signals, and the Site does not respond to them differently.
14. Changes to This Privacy Policy
We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above. If we materially change how we handle your information, we will give more prominent notice, such as a notice on the Site or a direct message. Continuing to use the Site after changes take effect means you accept the revised Policy.
